Terms of Service

1. Acceptance of Terms

By accessing or using the FIM platform (the “Platform”), including FutureX and the Dashboard, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Platform.

2. Description of Service

FIM provides a platform with two engines: FutureX, a terminal-first AI coding agent, and the Dashboard, a managed delivery interface for tracking projects from request to handover. The Platform includes web applications, APIs, CLI tools, and related services.

3. Eligibility

You must be at least 18 years old to use the Platform. By agreeing to these Terms, you represent and warrant that you have the legal capacity to enter into a binding agreement.

4. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized use.

We reserve the right to suspend or terminate accounts that violate these Terms or applicable law.

5. Acceptable Use

You agree not to:

  • Use the Platform for any illegal or unauthorized purpose;
  • Attempt to gain unauthorized access to any part of the Platform;
  • Interfere with or disrupt the integrity or performance of the Platform;
  • Reverse-engineer, decompile, or extract the source code of the Platform except as permitted by law;
  • Use the Platform to generate content that violates applicable law or infringes third-party rights.

6. Intellectual Property

Our IP. The Platform, including its code, design, branding, and documentation, is owned by Future Information Mastery and is protected by intellectual property laws. These Terms do not grant you any ownership rights.

Your IP. You retain all rights to the code, content, and data you create using the Platform. We do not claim ownership over your work product.

7. Payments & Billing

Paid plans are billed in advance on a monthly or annual basis as selected. Payments are processed securely through third-party payment processors. All fees are non-refundable except as explicitly stated in our refund policy.

For managed delivery projects in the Dashboard, a 30% deposit is required to begin work, with the balance due on completion per the agreed quote.

We may change our fees with 30 days' notice. Continued use after the fee change constitutes acceptance.

8. Limitation of Liability

To the maximum extent permitted by law, FIM and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform, even if advised of the possibility of such damages. Our total liability for any claim shall not exceed the amount you have paid us in the 12 months preceding the claim.

9. Disclaimer of Warranties

The Platform is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or secure.

10. Termination

Either party may terminate these Terms at any time. Upon termination, your right to use the Platform ceases immediately. Sections 6 (Intellectual Property), 8 (Limitation of Liability), and 11 (Governing Law) survive termination.

11. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any disputes shall be resolved exclusively in the courts of San Francisco, California.

12. Changes to Terms

We may revise these Terms from time to time. Material changes will be notified through the Platform or by email. Your continued use after changes take effect constitutes acceptance.
